Brenden Miller

Brenden joined Garland Hawthorn Brahe in 1986 and was admitted to the partnership in 1994.  Brenden has practiced exclusively in the area of litigation throughout his legal career.  His principal practice areas are commercial litigation, mediation and alternative dispute resolution, insolvency, industrial litigation and wills, probate and Succession Act litigation. 

 

Brenden’s focus is on delivering timely, strategic and commercially driven solutions to disputes.  He specialises in recovery and acts for several major commercial and investment banks in the enforcement of securities, appointments of receivers and liquidators, legal proceedings relating to defaulting borrowers and disputes arising under the Farm Debt Mediation Act.  In addition, Brenden acts for corporate and individual clients in property development and leasing disputes, claims for and defences to unfair dismissal and variations to contracts of employment, contested will matters, actions for and against executors and trustees and claims under the Succession Act.  He has provided expert advice and evidence in respect of professional indemnity insurance claims in the Supreme Court of New South Wales.   

 

Brenden is a member of the Supreme Court of New South Wales Equity Division Users Group.  He was also a member of the Attorney General’s Strategic Quality, appointed to undertake a review of civil procedure in New South Wales, which ultimately resulted in the implementation of uniform rules throughout the various Court jurisdictions. 

 

Brenden is an Accredited Mediator with LEADR.
